All and singular that plot or piece of ground situate at Sandymount in the Parish of Saint Mary, Donnybrook and in the Barony and County Borough of Dublin bounded on the west by Gilford Road, on the north partly by Gilford Road, partly by the holding of J.E. Byrne, lessee, partly by the holding of J.W. Beckett and others, lessees, and partly by the holding of L.H. Ormsby, lessee, on the east partly by the holding of J.E. Byrne, lessee, partly by the holding of J.W. Beckett and others, lessees, partly by the holding of L.H. Ormsby, lessee, and partly by another portion of the holding of J.E. Byrne, lessee, and on the south by another portion of the holding of J.E. Byrne, lessee, with the messuages and buildings erected thereon

Terms and conditions:
In consideration of the expense incurred by the lessee company in the erection of the eight messuages upon the above property, and of the several rents and sums of money reserved and made payable in the present lease and the covenants and agreements made by the lessee company and conditions, the lessor, by virtue and in exercise of the powers conferred on him by the will of 20 May 1904 by the Right Honorable Sidney, late Earl of Pembroke and Montgomery, and by the Settled Land Acts of 1882 to 1890, and with the consent of Lord Herbert, demises unto the lessee company the above property to hold from 29 September 2019 for the term of 72 years, paying the yearly rent of £126, and also paying during the said term the several additional contingent rents or weekly sums set down in the lease. The lessee company also undertakes to abide by the several other conditions laid down in the lease, including the construction of two roadways with footpaths, drains and sewers, and also the erection of 34 additional messuages or dwellinghouses, with all necessary cartilages, garages, out-buildings, offices, walls, fences, sewers, drains etc. The lessee company to pay to the lessor the yearly rent of £45.

(1) The Right Honorable Richard Charles Francis, Earl of Clanwilliam in Ireland and the Most Honorable George William Frederick, Marquis of Ailesbury (the trustees of the last will and testament of the Right Honorable Richard late Viscount Fitzwilliam in Ireland, deceased);
(2) The Right Honorable George Robert Charles, Earl of Pembroke and Montgomery;
(3) John Edmond Byrne of Upper Baggot Street in the County of Dublin, grocer.

Property:
All that lot or parcel of ground with the dwelling house and offices now standing thereon situate in the east side of Gilford Road, Sandymount in the Barony of Dublin, in the County of Dublin, bounded on the north-west, west and south-west by Guilford Road and Sandymount Green, and on the north and north-east partly by the holding of James Beckett, partly by the holding of Susan and Louisa Hepenstal and partly by an unleased portion of the Estate of the Earl of Pembroke and Montgomery, together with all the rights, members and appurtenances to the said lot or parcel of ground belonging or in any wise appertaining

Terms and conditions:
George Robert Charles, Earl of Pembroke, the party of the second part, being under the age of twenty-one, the parties of the first part demise, set and to farm-let unto John Edmond Byrne the above property (reserving to said George Robert Charles all manner of mines, minerals and royalties), to have and to hold from 29 September 1869, for and during the term of 150 years, yielding and paying unto George Robert Charles the yearly rents of £95 and £190.0.0; the former sum to be paid during the first three years, and the latter sum to be paid during the remainder of the term. Within the first eighteen months of the said term, Byrne to build and complete in a good and workmanlike manner on the said demised premises fronting to Gilford Road five good and substantial dwelling houses, of the best materials well roofed and covered with slates and best lead not more or less than two stories high and shall enclose the said demised premises with a stone or brick wall within the first twelve months of the said term, and within the first eighteen months of said term to expend the sum of £500.0.0 at least in putting the dwelling house and offices now standing on the premises into a permanent and complete condition of repair.

Accompanied by a map of the property. Includes a consent dated 28 May 1903, stating that the lessee shall, so long as any of the instalments payable to the Intermediate Education Board on foot of a loan about to be made on the security of the premises shall remain unpaid, use that portion of the said premises now known as the Academical Institution as a boarding school. Also includes a statement of consent dated 7 May 1918 by the Right Honorable Reginald, Earl of Pembroke and Montgomery, that the yearly rent of one hundred and ninety pounds reserved by the lease shall from 25 March 1918 be abated or reduced by the sum of £65.0.0 per annum.

A file relating to the road widening scheme at Rathfarnham and work carried out by Dublin Corporation on part of the boundary wall of Rathfarnham Castle and the subsequent problems that arose due to the Corporation's failure to complete the work. Includes a letter from Tom Bacon, Solicitor (acting on behalf of the Jesuit Fathers), 9 Clare Street, Dublin to Fr McDonald SJ Remarks 'This matter has taken a new and interesting turn... Mr Beausang (Dublin Corporation).. .explained his predicament. Apparently in his final anxiety to get the work through he agreed our terms without obtaining any additional estimates as to the cost... Mr Beausang states that there is a deficiency of at least £7,000...There is no fund out of which this deficiency can be met...Mr Beausang's first suggestion was that the Jesuit Fathers would make a grant to the corporation of half the increased cost namely £3,500. When he was told that this was out of the question it was then suggested that you might disclaim the acquisition money £2,000.' (11 October 1956, 3pp).
